We help clients develop comprehensive plans that describe how they wish to be cared for in the event of incapacity. This allows people to make decisions now for the time when they may be unable to do so. Typical documents used in incapacity planning include:

  • Health care directives or living will. These documents describe how you want to be treated at the end of life. They typically address issues such as life prolonging measures, palliative care, and resuscitation
  • Powers of attorney. They allow people to make decisions on your behalf about health care and financial matters to the degree that you specify
  • Guardianships and conservatorships. They name an individual to oversee your personal and legal affairs. These documents are particularly needed when there is no power of attorney or health care directive. If there is no named guardian or conservator, the court will appoint one on your behalf.
  • Medical assistance qualification/planning. We will discuss with you the pros and cons of asset transfers and explain the medical assistance rules and qualifications so that you can make an informed decision that is best for both you and your family.

Our elder law attorneys also advise on matters such as asset transfers to minimize estate tax for your heirs, long term care insurance to provide a suitable level of care should you become incapable of caring for yourself and need to enter a nursing home, and medical assistance (Medicaid) planning. If you hire us after the initial office conference, we will credit forward the amount paid for the first half hour toward future services. If you do not hire us, we keep the fees paid so we are reasonably compensated for the time and advice provided.
